Worker Injured in Fall from a Ladder
Our client suffered multiple fractures to the wrist, forearm and elbow when he fell from a ladder while taking down the ceiling in the basement of a building.
Our client had been provided with a 6-foot A-frame ladder by his employer. The ladder was unstable and moved from side to side every time he ascended or descended. Although he told his employer that the ladder moved when he first went up the ladder, his employer did not provide him with another ladder to use. At the time of his accident, he was on the fourth rung of the ladder using a hammer to demolish a portion of the ceiling when the ladder suddenly moved and he fell to the ground. He fell on his left side and suffered multiple injuries to his arm.
The fall from the ladder was the cause of his injuries, and his employer’s failure to provide an adequate ladder and safety equipment to prevent the fall were clear violations of N.Y. Labor Law §240(1).
