Jacob Oresky, Esq. was contacted by the family of an Ecuadorian construction worker who was killed in a construction accident. The construction worker was not provided with proper safety equipment to perform demolition of a building and was killed when he fell off the side of the building. The construction worker came to New York to support his family and provide for a better future.
The worker’s wife and children resided in Ecuador and were devastated by the tremendous loss of the head of their household. A significant wrongful death action was commenced against the building owner and contractor in charge of the construction for their negligence which resulted in the worker’s death. The construction worker’s wife wanted to serve as the administratrix of her husband’s estate and testify as a witness in the trial.
When the worker’s widow applied for a Visa to enter the United States to attend court proceedings, her application was denied.
