A huge chunk of the scaffolding around a building in Brooklyn fell to the ground last month, causing injury to two pedestrians and a construction worker. The incident occurred on Saturday, April 14, near the Borough Hall subway station near Joralemon and Court Street. According to a witness, who operates a food truck across the street from the building, workers were dismantling the scaffold when it came apart, with pieces falling on two pedestrians who were walking by. The building owner was apparently cited for failing to safeguard persons and property during a construction operation, a violation with a potential $25,000 fine.

New York Scaffold Injury Attorneys
New York State has enacted specific legislation to protect construction workers who are injured in scaffold accidents. Under New York Labor Law §240 contractors and most owners of construction projects where scaffolding is used have a duty to construct, place and operate that scaffolding in a way that provides proper protection to construction workers.
The statue establishes absolute liability on the part of owners and contractors. That means that, as an injured worker, you don’t have to show that the owner or contractor was careless or negligent. To recover compensation for a scaffold-related injury in New York City or across the state it is sufficient to show that the scaffold failed to provide you with proper protection and you suffered an injury as a result.
At Oresky & Associates, pllc, we have successfully helped many New York construction workers get full and fair compensation for injuries suffered in scaffold accidents. We have a thorough understanding of New York Labor Law §240 and can help protect your rights.
