Car Accident, Kills 17-Year-Old Pedestrian in Queens

Dead woman lying on a street

An 88-year-old woman is facing charges after she allegedly caused a fatal accident with a 17-year-old pedestrian on Monday, June 25. The incident occurred as the 17-year-old female pedestrian attempted to cross the intersection in Whitestone at 10:30 a.m.

According to authorities, the 88-year-old driver ran a red light as the pedestrian attempted to cross at Utopia Parkway and 16th Avenue.

The victim, who lived in Flushing, was struck by vehicle’s front bumper and hit the windshield before being thrown onto the sidewalk.

Emergency services arrived on the scene soon after the accident and rushed the 17-year-old victim to New York-Presbyterian Queens hospital. She was pronounced dead soon after being admitted.

Reports indicate that the police took the 88-year-old driver into custody after the incident. While the investigation is ongoing, she received a desk appearance ticket for:

  • Failure to yield to a pedestrian;
  • Running a red light; and
  • Failure to exercise reasonable care.

There is no way to prepare for losing a loved one in a car or pedestrian accident. Nor is there any amount of financial compensation that can make up for an unexpected passing.

However, wrongful death suits can help alleviate some of the burdens families face in the aftermath of fatal accidents. And Oresky & Associates, PLLC can help guide you and your family through this trying time.

In New York, a personal representative must file the wrongful death action. This person must be someone appointed by the court.

The following parties can benefit from a wrongful death action:

  • A spouse of the deceased
  • A child of the deceased
  • A parent of the deceased
  • The estate of the deceased

Under New York law, the personal representative of an estate can obtain legal help to file a claim such as this. The Oresky & Associates, PLLC team will do all the following when handling a wrongful death claim:

  • Thoroughly investigate the accident, interview witnesses, and locate evidence
  • Present the case from suit all the way through trial or settlement
  • Demand monetary damages for the sum of the family’s financial losses and the decedent’s pain and suffering

While no two wrongful death cases are the same, Oresky & Associates, PLLC seeks the following damages:

  • Medical bills
  • Loss of income & other financial benefits
  • Funeral expenses
  • Loss of household services
  • The deceased’s conscious pain and suffering
