On Tuesday, May 06, 2014, Joshua Goldblatt, Esq., a trial attorney at Oresky & Associates, PLLC., won a jury verdict in favor of the plaintiff, a back seat taxi cab passenger, when the cab was involved in a collision with another car.
After the car accident our client was taken by ambulance to Lincoln Hospital and discharged from the emergency room.
Our client was later diagnosed with a tear in her left shoulder, a fracture of the 8th rib, a sprain of her left knee, and other soft tissue injuries of the neck and back.
After an arthroscopic surgery and about 6 months of physical therapy, our client was unable to continue treatment because the no-fault insurance provider denied payment of future bills.
Defendants had offered $25,000 prior to trial. By stipulation, Defendants conceded liability in exchange for Plaintiff’s agreement to cap damages at the insurance policy limits of $200,000.
Trial lasted approximately 1.5 weeks against two different law firms representing the drivers and owners of the two vehicles involved in the car accident. At the conclusion of trial, the Bronx County Jury awarded our client $475,000 for her past pain and suffering and $625,000 for her future pain and suffering for a total award of $1.1 Million.*
