Worker falls from Sidewalk Bridge and wins $7,500,000* Settlement for accident claim under New York’s “Scaffold Law”

A sidewalk bridge installer was injured and fell approximately 20 feet when a 2×4 that he was leaning on snapped. The New York Labor Law establishes that property owners and general contractors have the legal responsibility to operate and maintain a safe workplace for workers engaged in construction, repair, and/or demolition activities. New York Labor Law #240 provides special protection to workers who are required to either work at elevations, or with elevated objects. Under Labor Law #240, workers who are injured by – or on – scaffolds, ladders, hoists, and other construction related equipment are entitled to recover money damages for their injuries. Virtually all such construction workers are protected.

This is called the “Scaffold Law.” It holds contractors and property owners (there are exceptions) engaged in construction, repair, or demolition of structures ABSOLUTELY LIABLE for injuries to their workers for falls from scaffolds, ladders, falling objects or other height related injuries. Injured workers can recover money for pain and suffering, lost wages, medical bills, and other resulting expenses. These damages would be in addition to Workers’ Compensation.
