Fall From Ladder Cases

According to the Occupational Safety and Health Administration (OSHA), falls are the leading cause of deaths in construction. In 2015, nearly 40 percent of all construction fatalities throughout the U.S. were due to falls. Many of these falls were from ladders. On construction sites, workers often are required to use ladders at a wide range of heights and levels. Depending on the nature of the job, construction workers may use stepladders, A-frame ladders, extension ladders, or other types of ladders.

New York Labor Law Section 240, also known as the “Scaffolding Law,” protects the rights of construction workers who have been injured by falls or falling objects. This law imposes a non-delegable duty on general contractors and most property owners to provide workers with proper protections, including safe and properly working ladders. When a ladder malfunctions for no apparent reason, a court will presume that the ladder was not adequate to provide proper protection. For example, if a ladder suddenly “kicks out” or topples over, the court will presume that the ladder was not good enough for the job.

Falls from ladders can cause serious injuries and even death. If liability is established under certain provisions of the Labor Law, such as Section 240, an injured worker will be able to recover significant damages related to the accident.
