Livery cabs are a popular form of transportation and are often confused with taxicabs. Similar to taxicabs, livery cabs are under the ownership of an individual or a company. They must also meet the standards set by laws governing their operation.

Unlike taxicabs, however, livery drivers cannot drive around waiting to be hailed by pedestrians. Rather, you must call one ahead of time to pick you up and agree to a set fare prior to arrival.

Despite their differences, similar laws govern both livery drivers and taxi drivers. And these drivers must exercise the same type of duty of care to passengers, pedestrians, and other drivers.

The following are some of the possible causes of livery car accidents:

    • Driver negligence or fatigue
    • Speeding
    • Improper cell phone use
    • Distracted driving
    • Failure to obey traffic laws
    • Driving under the influence
    • Illegal lane changes

New York’s laws require livery and taxicab drivers to maintain liability coverage with the following minimums:

    • $100,000 for a single person
    • $300,000 per accident

This coverage pays out for injuries a livery driver causes.
