New York’s Scaffolding Law Holds Property Owners and Contractors Liable when Construction Workers are injured by Falling Objects

New York’s Labor Law # 240 and 241 protects construction workers who are injured at buildings, on sidewalk bridges, scaffolds, ladders, and other areas of construction sites. It applies to injuries when workers fall, or are hit by falling objects which were being hoisted or should have been secured during the construction process. According to New York’s Scaffolding Law, contractors, property owners and their agents (such as subcontractors) must provide a safe construction site for all workers. Often, contractors or owners can fail to provide workers with safety equipment that could have been in place to prevent objects from falling on a worker. Their duty to secure materials and equipment is required since the statute obligates a worker to be protected at all times from being exposed to the risk of harm caused by a falling objects. When they fail in their legal duty, the Scaffolding Law allows injured workers to sue these responsible defendants for all of their damages (there are certain exceptions). Construction workers are protected by the Scaffolding Law, regardless of whether they are U.S. citizens, or undocumented workers.
