Scaffolding & Ladder Fall Lawyer

Representing Construction Accident Victims For More Than 30 Years

All too often construction workers suffer injuries in preventable falls from scaffolding and ladders. If these workers had the proper — and required — safety equipment, the fall may not have happened. While injured workers usually qualify for workers’ compensation, New York also has laws in place that may allow these workers and their families to hold certain owners and contractors responsible as well.

A scaffolding & ladder fall lawyer in New York City at Oresky & Associates, PLLC can help you understand if there are any legal remedies available to you beyond workers’ compensation. We might be able to help you collect additional compensation if you suffered injuries in an NYC fall that involved a ladder or scaffold, or that occurred because of a failure to provide proper safety equipment.

Workers’ Compensation and Other Protections Under New York’s Labor Laws

Any time a worker suffers injuries on the clock in New York State, they are entitled to collect benefits under the state’s workers’ compensation law. This includes benefits to cover:

  • Medical care
  • A portion of their lost wages

In the event of wrongful death, the surviving family would be entitled to receive benefits.

While Workers’ Compensation is intended to help injured workers, it does not cover a workers’ damages for pain and suffering as well as a family’s loss, such as the claims of a spouse. Construction workers have strong protections under New York Labor Law 240. This statute, also known as the Scaffold Law, provides potential additional legal remedies for workers who suffered falls from a height while on a construction site. This law also applies to workers struck by falling objects.

Frequently Asked Questions

Common Legal Questions

How Long Do I Have to File a Lawsuit After a Construction Accident?
Your time to file a construction lawsuit is limited by the statute of limitations. New York gives you three years from the date of the accident to initiate a personal injury lawsuit. The statute of limitations is a hard deadline. If you fail to file your lawsuit within the time limit, you will be barred from recovering compensation.
What Damages Are Available to Construction Accident Victims?
There are two main types of damages available to construction accident victims. Economic damages cover financial losses, such as medical expenses, lost wages, and diminished earning capacity. Non-economic damages cover personal, non-monetary losses related to the accident. These include pain and suffering, emotional distress, scarring/disfigurement, and loss of consortium. Rare cases may qualify for punitive damages, such as incidents where the construction company ignored safety standards.
How Much Is My Construction Accident Case Worth?
The value of your case will depend on many different factors. Your economic damages, which are the direct financial losses you’ve sustained in the accident, will make up a large portion of your compensation. These damages include medical expenses and lost wages, among other things. Your non-economic damages, which represent the personal, non-financial losses related to the accident, will also influence your case’s worth. Other factors, such as available insurance coverages and comparative fault, can also affect your award.
Can I Still Recover Damages If I’m Being Blamed for a Construction Accident?
Yes. You can still recover compensation if you are being blamed for a construction accident. Workers' compensation is a no-fault system. If you are seeking workers’ comp, you can recover benefits regardless of whether you are at fault for the accident. If you are filing a third-party suit and are partly at fault, New York’s pure comparative fault rules will come into play. In this case, your compensation will be reduced to account for your share of the blame for the construction accident.
How Do I Make an Accident Report from a Construction Accident?
If you suffered injuries in a construction accident, you must report the accident to your foreman or employer, but there are other steps you also must take if you hope to receive compensation for your injury. First things first! If you have been hurt, seek medical care and attention immediately. If you need an ambulance, ask for one to be called. Your construction foreman may or may not be aware of your accident. Do not assume they received word of the incident. Even if you verbally told your co-worker about it, this notification will not always help you if your employer does not have actual knowledge of your construction accident. New York City Construction Site Accidents and Liability

When a construction worker falls from a ladder or scaffolding, the injuries they suffer can be catastrophic. Broken bones that keep them from working for several months are almost a best-case scenario if the fall is more than a few feet. Other common outcomes include:

The serious nature of these injuries often means there is no way workers’ compensation will be able to cover all the expenses and losses associated with them. From out-of-pocket costs to pain and suffering, workers compensation will not prove sufficient. This is why New York Labor Law 240(1) allows construction workers to hold certain property owners and contractors liable for additional civil damages under certain circumstances.

If we can show the property owner and/ or contractor at the construction site failed to provide adequate safety equipment as required by law, we may be able to help you collect a wide range of damages not covered by workers’ compensation. This could include:

  • Lost Union Benefits
  • Rehabilitation and therapy costs
  • Additional lost wages
  • Lost earning capacity
  • Pain and suffering damages

When we review your case, we can explain if we believe you have a strong case against the potential defendants. We will investigate your fall and try to uncover evidence that allows us to file an insurance claim or lawsuit against them.

Even if you feel that you are at fault for the accident, under New York Labor Law 240(1), your comparative fault will not be considered a defense to the owner or contractors involved.

Common Contributing Causes to Scaffolding and Ladder Falls

Under New York Labor Law 240(1), workers who perform work on ladders, scaffolds, and other similar platforms must receive special protections designed to prevent falls. This includes requiring property owners and contractors to provide:

  • Safe and well-maintained ladders and scaffolding
  • Harnesses and other safety systems
  • Safety life lines and hooks
  • Any other required fall protection equipment, depending on the situation

Our Scaffolding and Ladder Fall Attorney Will Evaluate Your Case

Our attorneys understand the complex state laws that protect construction workers and allow you to pursue legal remedies if you were not provided with proper fall protection equipment or if you were provided with poorly maintained ladders or scaffolding that caused your accident. If we believe you have a strong case against a property owner or contractor, we will be vigorous advocates fighting for the compensation you deserve.

We can:

  • Review your case for free and handle it based on a contingency
  • Explain the applicable laws that provide strong protections for workers
  • Investigate your case and keep you informed each step of the way.
  • Try to help you recover the maximum amount possible based on the damages you suffered
  • Keep you prepared and ready from the beginning until settlement or trial.

Many of our staff members are bilingual and can discuss your case in English or Spanish, whichever makes you feel more comfortable. It is also important to note that your immigration status plays no role in getting workers’ compensation or pursuing civil remedies.
