What Can You Do After An Uber Accident?

Liability for Car Accidents Involving Uber Vehicles

Accidents involving rideshare vehicles like an Uber are more complex than other car accident cases. Uber drivers are insured by Uber’s insurance policy when driving, but coverage depends on whether they have a passenger, are going to pick up a passenger, or are waiting for a ride request. If the driver was not working, then their personal car insurance covers them. If a vehicle other than the rideshare vehicle caused the accident, then that driver’s insurance policy will provide coverage.

When you hire us to handle your case, we will identify the liable party and sort out all the details, including the appropriate insurance policy to file your claim. The team at Oresky & Associates, PLLC has won over $400 million in settlements and verdicts for our clients. Let us help you too.

Frequently Asked Questions

Common Legal Questions

Can I Get Compensated if I Was Partly at Fault for My Motor Vehicle Accident?
The short answer is yes - many times, you can be compensated if you are partly at fault. Again, New York is a no-fault insurance state in which your own insurance pays for your out-of-pocket costs such as limited lost wages and medical bills up to $50,000.  When you make a claim for pain and suffering as well as certain economic loss above no-fault, the percentages of fault will be considered in your recovery. Your injury from your motor vehicle accident may have a certain value, however, fault will be taken into consideration at the time of trial or settlement.
What Damages Are Available if I’m Injured in a Motor Vehicle Crash?
Damages are recoverable for past and future pain and suffering, economic loss, such as lost wages, medical expenses, rehabilitation, therapy, and long-term residential care will also be considered damages under the law.  Union members may recover lost future benefits.  Other damages are recoverable and will be reviewed on a case-by-case basis.
What Happens if the Other Driver Was Uninsured?
If the other driver was uninsured we can file an uninsured motorist claim under your vehicle’s insurance policy.  Automobile insurance policies written for New York State motorists are required to have uninsured protection.  This insurance will provide financial compensation to you, if the at fault driver does not have insurance. If you must file through your own insurer, you need a skilled law firm to help you recover the maximum money damages available.
How Is Fault Determined in a Motor Vehicle Accident?
Fault is determined by the way that the accident happened.  Did a driver go through a light or stop sign?  Was the driver speeding or driving unreasonably under the circumstances?  New York is a comparative fault state, meaning you can still recover some compensation for damages even if you are the mostly at-fault driver. Many times, the crash is a result of both drivers who share percentages of the fault.
What Should I Do After a Motor Vehicle Accident?
After a motor vehicle accident, you should always call for help. While you wait for help to arrive, check for injuries—both your own and those of others involved in the collision. Be sure to accept necessary medical attention from any paramedics on the scene and follow up with a health care provider as soon as possible in the days following the accident. Last but not least, connect with a lawyer––and do it fast. Get more information on what to do after an auto accident by reading our full post.

Damages Awarded in Uber Accident Cases in New York

Those who were injured or have lost a family member in a rideshare accident deserve justice. Oresky & Associates, PLLC has won millions in settlements and verdicts for clients hurt in automobile accidents, including pedestrians.

Do not accept a settlement offer or sign anything from the insurance company without first speaking with a lawyer about your Uber accident. Call Oresky & Associates, PLLC. A few of the settlements and verdicts we have recovered for victims of motor vehicle accidents include:

  • $4.6 million verdict for a driver injured in a three-car accident.
  • $4.5 million awarded to the family of an 81-year-old pedestrian killed in a motor vehicle accident.

Your damages depend on the extent of your injuries,  expenses and losses. In New York, a personal injury victim is eligible to collect economic damages and non-economic damages. Recoverable damages include:

  • Medical bills. You can pursue reimbursement for medical bills, including hospitalization, surgical costs, medication costs, and other treatment expenses in excess of no-fault insurance coverage.
  • Rehabilitation costs in excess of no-fault insurance coverage.
  • Lost wages and earnings in excess of no-fault insurance coverage.
  • Pain and suffering. You may recover significant compensation for past and future pain and suffering, as well as other non-economic effects of the injury on your quality of life.

This is not a complete list of recoverable damages. Jacob Oresky & the team at Oresky & Associates, PLLC will fight for the full value of your losses. Call us now: (718) 993-9999.

Uber’s Insurance Policy

The following is an overview of Uber’s insurance policy.

  • If the Uber driver is not working (i.e., their app is turned off), the Uber insurance policy does not apply, and their personal insurance policy would cover the driver.
  • If the Uber driver has their app turned on and is waiting for a ride request, Uber provides third-party liability coverage if the rideshare driver’s private insurance does not. Coverage includes $50,000 in bodily injury liability per person, $100,000 in bodily injury per accident, and $25,000 in property damage liability.
  • If the Uber driver has received a ride request and is en route to pick up a passenger or is actively transporting a passenger in their vehicle, Uber provides $1 million in third-party liability coverage.

Other parties, such as another driver, may also be liable for your injuries, so work with an attorney at our firm to sort out liability and pursue the appropriate insurance policy and responsible parties.  Give us a call today to get started: (718) 993-9999.
