Rights of Roofers Injured In Fall Accidents

If you or a loved one has been injured in a roofing accident, you need an experienced attorney by your side to help you through the difficult legal system ahead. New York Labor Law 240(1) protects those working on a roof who suffer a fall due to a failure to have proper protection. Contractors, employers and commercial owners are responsible to provide roofers with fall protection equipment.

A roofer injured in a fall from the roof, a roof collapse, fall from a ladder, scaffold is entitled to seek Workers’ Compensation, and also may have the right to commence a separate claim or law suit for money damages for personal injuries, including pain and suffering, lost wages, and other damages.

Labor Law 240(1) and Falls from Roofs

Labor Law 240(1) requires contractors, construction site and building owners to provide fall protection for their workers. This includes safe ladders, scaffolding, harnesses, safety lines, and other devices to keep a worker safe, and to prevent the worker from falling. Should this equipment not be available or fail, even if the worker was found to be partially at fault for the accident, the contractor or owner may be found 100% responsible.
